Negotiating Mutually Agreeable Terms
Mediation is a successful legal formality to be held prior to attending a hearing on your case. Mediation is not a trial. This process allows both sides to outline areas of agreement before a winner or loser is determined in the hearing. A benefit of this process is that both parties have some control over their respective destinies – as opposed to letting a third party decide each side’s fate.
The Mediation Process
The injured worker, a representative of the insurance company, the lawyers for each side, and a mediator meet to discuss a settlement relating to expenses incurred by the employee due to injuries on the job. They talk about the facts and legalities of the case, but no evidence is presented. Resolution is reached when all parties agree to the final settlement terms.
Neither side can be forced to settle the case. One or both sides can end the mediation.
